LEGAL PRACTICE ACT: DRAFT AMENDMENT BILL OUT FOR COMMENT

The Department of Justice & Constitutional Development has gazetted a notice calling for input by 11 September 2026 on a draft Legal Practice Amendment Bill.

Approved by Cabinet on 29 July 2026 for the required public consultation process, according to a media statement on the meeting concerned the draft Bill seeks to:

  • ‘streamline the administrative structures of the legal sector while advancing transformation’
  • introduce ‘structural changes to the Legal Practitioners’ Fidelity Fund to strengthen financial sustainability and enhance public protection’
  • strengthen various provisions in the principal statute to:
    • ‘support the development and enhancement of (the) skills of legal practitioners’
    • ‘improve access to the legal profession’
    • ‘promote access to justice’, and
  • ‘address practical challenges’ arising during the Act’s implementation.
