The Office of the Legal Services Ombud has gazetted a notice calling for input by 31 January 2024 on draft rules that, once finalised, will replace and repeal those gazetted in April 2022.
The document concerned makes no reference to the context in which the proposed new rules were developed. However, according to a preamble to those now in place, they were compiled ‘without prior publication for comment’ because of the ‘staggered manner’ in which the Legal Practice Act, 2014, was operationalised.
Apparently, this affected the Legal Practice Council’s disciplinary processes – among other things by delaying the resolution of disputes and any associated redress. This is understood to have impacted negatively on public perceptions of the legal profession.
