ActionSA MP Dereleen James has announced her intention to introduce the following Bills in Parliament:
- a National Prosecuting Authority (NPA) Amendment Bill, and
- a South African Police Service (SAPS) Amendment Bill.
Gazetted in the form of separate procedurally required explanatory summaries of the legislation envisaged, the documents also call for comments on the proposals concerned. The deadline for input is 22 November 2026.
The draft NPA Amendment Bill seeks to:
- ‘strengthen and further institutionalise the Investigating Directorate against Corruption by clarifying and expanding its mandate, jurisdiction and institutional arrangements’
- ‘reinforce its operational capacity, security of tenure, financial arrangements, accountability and continuity’, and to
- provide for ‘an integrated specialist capacity’ to:
- ‘prevent, investigate and prosecute serious corruption matters, organised crime, serious commercial and financial crime, and offences affecting the integrity of the state, constitutional institutions and public administration’, while
- ‘preserving prosecutorial independence and the lawful exercise of prosecutorial discretion’.
With that in mind, the draft SAPS Amendment Bill seeks to:
- ‘dissolve the Directorate for Priority Crime Investigation’
- ‘transfer its functions, affected personnel, assets, liabilities, records and information systems to the NPA’
- ‘preserve the validity of prior acts’
- ‘ensure that pending investigations and related proceedings continue without interruption’, and to
- provide for:
- regulations governing transitional arrangements, and
- consequential legislative amendments.
