LOCAL GOVERNMENT: COUNCILLORS' CODE OF CONDUCT IN FORCE

The draft code of conduct for municipal councillors released in October 2022 for public comment has been finalised and gazetted.

In addition to setting general performance and behaviour-related standards, the code of conduct deals with:

  • attendance and voting at meetings
  • the procedures to be followed when declaring any gift received over R1000 in value
  • the obligations of a municipal manager when a councillor is more than two months in arrears with payments for municipal rates and services, and
  • a municipal council speaker’s obligation to report bi-annually on councillors’ compliance with the code.

Immediately effective and falling under the Local Government: Municipal Structures Act, 1998, the new code repeals and replaces regulations in force since May 2001 under the Local Government: Municipal Systems Act, 2000 – and dealing only with the declaration of gifts.
