LOCAL GOVERNMENT: DRAFT GENERAL LAWS AMENDMENT BILL OUT FOR COMMENT

Please note: On 26 June 2024, a notice was gazetted extending the deadline for comment to 31 July 2024. On 2 August, the deadline was further extended to 31 August 2024.

The Department of Co-operative Governance & Traditional Affairs has gazetted a draft Local Government: General Laws Amendment Bill – calling for input by 28 June 2024.

According to a memorandum on the draft Bill’s objects, it seeks to:

  • ‘entrench good practices’, and
  • ‘address the challenges that have been experienced’.

With that in mind, the proposed new piece of legislation provides, among other things, for:

  • a raft of measures and procedures affecting:
    • municipal managers and acting municipal managers
    • managers reporting directly to municipal managers
    • dismissed staff members
    • bargaining council negotiations
    • financial misconduct
    • unauthorised, irregular or fruitless and wasteful expenditure
    • councils and councillors
    • ward and public accounts committees
  • ‘the electronic communication of information in respect of community participation’
  • due consideration of the ‘additional needs of women and youth’ in consultation processes
  • the inclusion of ‘growth and climate change scenarios’ as a ‘core component’ of integrated development planning, and
  • input from national and provincial organs of state to municipal integrated development planning processes.
