MAGISTRATES’ COURTS: INPUT SOUGHT ON SALE IN EXECUTION RULE CHANGE

On behalf of the Rules Board for Courts of Law, the Department of Justice & Constitutional Development (DoJCD) has called for public comments on draft amendments to the Magistrates’ Courts rule on procedures related to the sale in execution of attached immovable property. The deadline for input is 29 May 2026.

The amendments proposed seek to:

  • clarify the proceedings to be followed by a court where the sale in execution of an attached immovable property does not achieve the prescribed reserve price
  • set out the procedure to be followed when bringing a reserve price reconsideration before a court, and to
  • clarify the application of related sub-rules.
