MAGISTRATES’ COURTS RULES: CIVIL APPEALS & REASONS DUPLICATIONS TO BE ADDRESSED

On behalf of the Rules Board for Courts of Law, the Department of Justice & Constitutional Development has issued a notice calling for input on proposals for consolidating two Magistrates Courts sub-rules affecting reasons-in-writing obligations in the context of civil appeals. The deadline for comment is 31 August 2026.

In particular, Rules Board correspondence calls for input on:

  • aligning the proposed combined provisions with a Uniform Rule dealing with similar matters
  • the implications for ex tempore judgments of combining the provisions concerned
  • reasons for opposing the consolidated sub-rule proposals, and
  • possible alternatives for addressing the duplication.
