MAIL CONVEYANCING REGULATIONS FOUND WANTING

Please note: On 25 March 2024, ICASA gazetted a position paper identifying aspects of the October 2009 regulations likely to be amended. Draft amendments will be released in due course for public comment.

The Independent Communications Authority of South Africa (ICASA) has gazetted a findings document as the next step in an inquiry into mail conveyancing begun in 2023. The findings were informed by input on a discussion document released in March that year.

According to ICASA, prevailing mail conveyance ‘challenges’ cannot be addressed effectively under the existing regulatory framework. This is noting that, among other things, the October 2009 regulations do not:

  • ‘cater’ for the entire mail conveyance process
  • adequately protect consumers against the loss and damage of goods, and in that context
  • appear to fall far short of providing for the necessary insurance.

Against that backdrop, draft amendments to the regulations are likely to follow.
