MARINE BIODIVERSITY: OFFSHORE SHIP-TO-SHIP TRANSFER REGULATORY UPDATE

The Department of Forestry, Fisheries & the Environment has called for input by 3 August 2025 on a revised version of draft regulations intended to reduce the impact of offshore ship-to-ship transfers on marine biodiversity. Released in February 2025 for public comment, as SA Legal Academy reported at the time the proposals also deal with bunkering (the supply of fuel to a vessel at sea outside an operational harbour area).

Informed by input on the first draft, among other things the revised proposals introduce a different approach to managing ship-to-ship transfers in:

  • aquaculture development zones
  • African penguin breeding colonies, as well as in the context of
  • nighttime bunkering, and
  • underwater noise.
