MARINE OIL POLLUTION: INPUT SOUGHT ON PREPAREDNESS, RESPONSE & CO-OPERATION BILL

In anticipation of parliamentary hearings on the Marine Oil Pollution (Preparedness, Response & Co-operation) Amendment Bill, the National Assembly’s Transport Committee has called for written submissions by 16 August 2023.

Tabled in January 2022, once operationalised the Bill will incorporate International Convention for the Prevention of Pollution from Ships Annexures IV and VI into the principal statute. This is noting that:

Annex IV deals with sewage from ships and came into force in September 2003, and that

Annex VI deals with air pollution from ships, was added to the Convention by the 1997 protocol and came into force in May 2005.

According to a memorandum on the Bill’s objects, when the principal statute was ‘passed into law’ in 1986, the Convention’s Annexures I, II, III and V were included – ‘to the exclusion of Annex IV’. It is not clear why.
