MARINE SHIP POLLUTION ACT REGULATIONS: INPUT SOUGHT ON DRAFT AMENDMENT

In anticipation of the Marine Pollution (Prevention of Pollution from Ships) Amendment Bill’s promulgation, the Department of Transport has gazetted a notice calling for input by 29 January 2024 on a proposed amendment to regulations under the principal Act. Once finalised, they will give effect to Annexures I to VI of the International Convention for the Prevention of Pollution from Ships, 1973.

At the time of writing, however, the draft amendment had yet to be posted on the South African Maritime Safety Authority website.

Tabled in January 2022, the Bill itself was adopted in February 2023 by the National Assembly’s Transport Committee. According to a report tabled in the House with the Bill in anticipation of its second reading, no changes have been made. Nevertheless, an additional report tabled several days later alludes to the possibility that amendments to the regulations may address some issues raised by stakeholders during parliamentary hearings on the Bill and in written submissions.

Although neither report was featured in the order paper for the National Assembly’s last sitting for 2024, the NCOP committee to which the Bill will eventually be referred when passed was briefed in October 2023 on its contents.
