MARRIAGE BILL: SUBMISSIONS SOUGHT FOR POST-ELECTIONS PARLIAMENTARY PROCESSING

In anticipation of a new National Assembly Home Affairs Committee beginning its work in a post-elections seventh democratic Parliament, a notice has been issued calling for submissions by 17 May 2024 on the Marriage Bill.

Tabled in December 2023, among other things the Bill seeks to:

  • rationalise marriage laws pertaining to various types of marriages in order to allow for their conclusion and solemnisation ‘regardless of religious, cultural, sex, gender, sexual orientation or any other beliefs of the prospective spouses’, and
  • ‘provide for the requirements for monogamous marriages … (and) polygamous marriages’.

Once passed, enacted and operationalised, the proposed new piece of legislation will recognise existing marriages concluded in terms of the Marriage Act, 1961, the Civil Union Act, 2006, and the Recognition of Customary Marriages Act, 1998 – as well as marriages concluded in line with Sharia law and other religious beliefs or practices.
