MEDICO-LEGAL CLAIMS: STATE LIABILITY AMENDMENT BILL TO BE WITHDRAWN?

The National Assembly’s Justice & Correctional Services Committee has tabled a report in the House to all intents and purposes recommending the withdrawal of the 2018 State Liability Amendment Bill, which it believes to be ‘undesirable’.

This is noting the apparently imminent completion of a South African Law Reform Commission (SALRC) review of the broader medico-legal claims legislative framework.

In the committee’s view, amendments to the Act should be informed by:

  • recommendations in the SALRC report once it has been finalised, and
  • ‘meaningful’ stakeholder consultations, which should include National Treasury and the Department of Health.

‘Piecemeal amendments’ to the Act should be avoided.
