MERCHANT SHIPPING ACT: AMENDMENTS PROPOSED FOR TRAINING, CERTIFICATION AND SAFE MANNING REGULATIONS

Please note: A South African Maritime Safety Authority official has confirmed by email that the regulations are, indeed, a draft on which public comment is now sought. Disparities between the two Government Gazette notices should be ignored.  

The Department of Transport has gazetted a notice calling for input by 11 December 2023 on draft amendments to regulations under the Merchant Shipping Act, 1951. Focusing on training, certification and safe manning, the changes envisaged have significant implications for fishing vessels and their crew.

The draft regulations themselves were made available by the South African Maritime Safety Authority (SAMSA) and are attached to a Government Gazette notice nevertheless tending to suggest that the amendments are a fait accompli.

Both notices feature the same number and date, but only one calls for public comments. Clarity is needed.
