MERCHANT SHIPPING: MARINE POLLUTION-RELATED, MARINER SAFETY REGULATIONS OUT FOR COMMENT

Please note: The draft regulations became available on 7 November 2024 –  also making 20 December 2024 the new deadline for submissions. This report has been updated accordingly, with a link to each document. The revised sections of the report are emboldened in red.

The Department of Transport has gazetted notices calling for public comments by 20 December 2024 on draft amendments to six sets of regulations affecting merchant shipping. Unfortunately, however, at the time of writing the proposed amendments themselves had yet to be published on the South African Maritime Safety Authority website. SA Legal Academy will update this report as soon as the draft regulations are available.

This notwithstanding, once in force the amendments envisaged will have implications for:

  • seafarer accident insurance and labour-related matters (draft regulations)
  • life-saving appliances (draft regulations)
  • marine pollution (informed by the BHC code for constructing and equipping ships carrying dangerous chemicals in bulk) (draft regulations)
  • marine pollution (informed by the IBC code for constructing and equipping ships carrying dangerous chemicals in bulk) (draft regulations)
  • marine pollution (informed by the IGC code for and constructing and equipping ships carrying liquified gases in bulk) (draft regulations)
  • related administration (preparedness, response and co-operation) (draft regulations)

The draft preparedness and response regulations are intended to give practical effect to the Marine Oil Pollution (Preparedness, Response & Co-operation) Bill now before Parliament and under consideration by the NCOP committee concerned.
