MERCHANT SHIPPING: RECENTLY TABLED BILL TO REPEAL AND REPLACE THREE ACTS

Once enacted and operationalised, a Merchant Shipping Bill recently tabled in Parliament will repeal and replace the Merchant Shipping Act, 1951; the Marine Traffic Act, 1981; and the National Ports Act, 2005.

According to a memorandum on the Bill’s objects, among other things it seeks to:

  • make the Minister and the South African Maritime Safety Authority responsible for the registration, permitting and licensing of ships in South Africa
  • establish a shipping information centre
  • apply South Africa’s labour laws to seafarers, regulating their conditions of employment and safeguarding their ‘health and well-being’ when on board a vessel
  • promote ‘the safety of life at sea’ by introducing ‘inspection and enforcement mechanisms’ to deal with ‘marine casualties and crimes committed on ships’
  • regulate marine traffic, and
  • ensure compliance with binding international conventions.

The proposed new piece of legislation was released in draft form in 2020 for public comment.
