MINE CLOSURE ENVIRONMENTAL MANAGEMENT: MORE TIME TO COMPLY WITH FINANCIAL PROVISIONING REGULATIONS?

The Department of Forestry, Fisheries & the Environment has called for input by 18 June 2023 on a possible five-month extension to the transitional period prescribed in the 2015 mine closure financial provisioning regulations.

These regulations prescribe the requirements to be met pre-mine closure for the management, rehabilitation and remediation of environmental impacts caused while a mine is operational.

The transitional period applies to the holders of mining rights and permits obtained before 20 November 2015 under the Mineral & Petroleum Resources Development Act, 2002.

It is proposed that, until 19 February 2024, the holders of such rights and permits should be regarded as having complied with the necessary requirements. Unfortunately, no fully updated version of the frequently amended regulations is available.
