MINERAL & PETROLEUM RESOURCES: DRAFT AMENDMENT BILL OUT FOR COMMENT

The Department of Mineral Resources & Energy has called for input by 13 August 2025 on a draft Mineral & Petroleum Resources Development Amendment Bill seeking to:

  • ‘enhance investor confidence by removing red tape and providing regulatory certainty’
  • ‘attract and retain investment’
  • ‘address key regulatory gaps’
  • ‘streamline licensing processes’
  • ‘ensure (the) equitable distribution of mining benefits’
  • ‘promote local processing and manufacturing industries by ensuring that more raw minerals are transformed into higher-value products within South Africa’
  • introduce ‘a licensing regime for artisanal and small-scale mining operations, thereby enhancing economic growth’, and
  • ‘strengthen regulatory measures to combat unlawful activities’ (including ‘clear prohibitions and enforcement mechanisms in relation to illegal mining’).

This is according to a media statement on the Cabinet meeting at which the draft Bill was approved for release into the public domain for comment.

A statement issued by the department itself on behalf of Mineral Resources Minister Gwede Mantashe gives context to the draft Bill by focusing on a ‘critical minerals and metals strategy’ also recently approved by Cabinet. Noting the importance of facilitating ‘critical minerals development and beneficiation close to the point of production’, the statement also draws attention to ‘targeted interventions’ dovetailing with provisions in the draft amendment Bill. At the time of writing, the strategy had yet to be made public.
