MONEY LAUNDERING, TERRORISM FINANCING: INPUT SOUGHT ON DRAFT AMENDMENT BILL

Please note: Shortly before close of business on 15 January 2026, National Treasury posted a media statement on its website providing further information on the draft Bill. Unfortunately, however, the proposed new piece of legislation itself had still not been published by 18:00 that day*. According to the statement, the draft Bill is an ‘expanded’ version of one released in December 2024 for public comment. Developed in liason with the Department of Trade, Industry & Competition, the Department of Social Development, the Financial Intelligence Centre, the Prudential Authority and the Financial Sector Conduct Authority, the revised draft seeks to further strengthen the country’s anti-money-laundering/counter-terrorism-financing system. *2) The draft Bill was eventually published later that evening, more than 24 hours after the Government Gazette notice calling for public comments.

National Treasury has gazetted a notice calling for input by 13 February 2026 on a draft General Laws (Anti-Money Laundering & Combating Terrorism Financing) Amendment Bill. Unfortunately, at the time of writing the document concerned had yet to be posted on department’s website.

However, according to the notice itself the draft Bill seeks to amend the:

  • 1997 Non-Profit Organisations Act (enabling the application of monitoring and enforcement measures)
  • 2008 Companies Act (providing for non-compliance-related deregistration, administrative penalties and an appeals process)
  • 2001 Financial Intelligence Centre (FIC) Act (empowering the FIC to conduct lifestyle audits; and strengthening a range of existing provisions), and the
  • 2017 Financial Sector Regulation Act (among other things empowering regulators to institute investigations; and bringing new services within the ambit of existing measures).
