NATIONAL FORESTS ACT: INPUT SOUGHT ON PROPOSED AMENDMENTS TO THE REGULATIONS

Please note: On 17 October 2023, revised draft amendments to the regulations were gazetted for comment. 

The Department of Forestry, Fisheries & the Environment has called for input by 7 April 2023 on draft amendments to the 2009 regulations. Focusing on the appeals process, the amendments envisaged deal with:

  • procedures to be followed from the time of an alleged contravention under sub-section 7(5) of the Act (inserted by section 3 of the National Forests Amendment Act, 2022, which is not yet in effect), and
  • steps to be taken when establishing an appeals committee.

Once in force, sub-section 7(5) of the principal Act will set out the process for dealing with activities threatening the survival of indigenous trees or other indigenous vegetation in a natural forest.
