NATIONAL PETROLEUM COMPANY BILL TABLED IN PARLIAMENT

Parliamentary papers have confirmed that a South African National Petroleum Company Bill has been tabled with the aim for formally constituting the entity launched in May 2025 to ‘participate in the exploration and production operations … (necessary for ensuing) security of energy supply’.

Released in draft form in November 2023 for public comment, according to a memorandum on the Bill’s objects, once passed by Parliament, enacted and operationalised, among other things it will enable to the company to:

  • ‘enter into and execute concession agreements with other governments … (and strategic partners)
  • acquire ‘interests in petroleum refining, storage, marketing (and) aggregation, … (as well as in the) of petroleum and petroleum products’, and to

‘develop, participate (in), operate and acquire energy infrastructure, including, but not limited to, transmission pipelines’.

The Bill also:

  • provides for a raft of matters related to the company’s governance/management structures and functions, and
  • gives practical effect to a June 2020 Cabinet decision requiring the Central Energy Fund to merge the South African Gas Development Company SOC Limited (iGas), the Petroleum Oil & Gas Corporation of South Africa SOC Limited (PetroSA) and the Strategic Fuel Fund into a single state-owned company.

In that context, the Bill includes ‘transitional arrangements … (regarding) the transfer of human resources and assets from (these entities) to the company’.
