NATIONAL PORTS ACT: DRAFT AMENDMENT BILL GAZETTED FOR ‘MARITIME STAKEHOLDER’ INPUT

Please note: On 9 October 2023, the Department of Transport gazetted a notice withdrawing the draft amendment Bill.

The Department of Transport has called for comments from ‘maritime stakeholders’ on a first draft National Ports Amendment Bill. The deadline for input has been set at 5 October 2023, with consultations planned for later that month.

According to the accompanying Government Gazette notice, the first draft of this amendment Bill was informed by:

  • implementation challenges experienced since the Act’s commencement
  • ‘international and domestic policy developments and performance trends’
  • the 2017 comprehensive policy on maritime transport
  • ports regulator provisions to the 2020 Economic Regulation of Transport Bill now being processed in the NCOP, and
  • ‘recent pronouncements’ on ‘the future reporting and governance arrangements’ of state-owned transport entities.
