NATIONAL SMALL BUSINESS ACT: MICRO, SMALL, MEDIUM ENTERPRISE CLASSIFICATION CRITERIA REPLACED

The Department of Small Business Development has gazetted proclamations immediately replacing a schedule to the 1996 National Small Business Act prescribing the criteria to be used when classifying an enterprise as micro, small or medium.

  • One proclamation gives effect to section 8 of the 2024 National Small Enterprise Amendment Act, which repeals the schedule to the 1996 principal statute. It is accompanied by a presidential minute.
  • A separate proclamation inserts a replacement schedule setting out the new criteria.

The new classification criteria were released in draft form in September 2025 for comment, as SA Legal Academy reported at the time.
