NCOP COMMITTEE CALLS FOR SUBMISSIONS ON TWO BILLS WITH PROVINCIAL IMPLICATIONS

The NCOP Committee on Land Reform, the Environment, and Mineral Resources & Energy has published notices calling for written submissions on two section 76 Bills affecting the provinces: the Electricity Regulation Amendment Bill’s ‘B’ version (by 29 April 2024); and a ‘B’ version of the Plant Health (Phytosanitary) Bill (by 22 April 2024).

Turning to the Plant Health (Phytosanitary) Bill, it was tabled in July 2021, passed by the National Assembly on 20 February 2024, and

seeks to address ‘gaps and challenges’ in the prevailing system noting:

  • the requirements of South Africa’s ‘major trading partners’
  • the country’s obligations under ‘relevant international agreements and treaties’ to which it is signatory, and
  • the importance of a ‘sound, nationally co-ordinated phytosanitary system’ in maintaining and expanding South Africa’s ‘competitive position in the global trade arena’.

Typographical changes made by the National Assembly’s Committee on Agriculture, Land Reform & Rural Development are reflected in its report. However, a ‘B’ version of the Bill incorporating these changes – and on which submissions are now sought – is not yet available.

Parliamentary procedural requirements for section 76 Bills during the NCOP process include subjecting them to thorough public consultations under the auspices of each provincial legislature. With that and the new pre-elections NCOP programme in mind, it seems likely that both Bills have already been sent to the provinces.
