NEW LEGISLATION: THREE MORE BILLS SIGNED INTO LAW

Please note: On 23 July 2024, the Acts were gazetted shortly before close of business. Not one of them is yet in force. The new legislation is:

The Presidency has issued separate media statements announcing the enactment of three more Bills. At the time of writing, none of the new Acts had been gazetted, so their commencement dates are not yet clear. Against that backdrop, the latest Acts to join the statute books are:

  • the Public Procurement Act (intended to create a single framework for all organs of state, ‘with the necessary efficiency, cost-effectiveness and integrity’ and underpinned by government’s commitment to broad-based black economic empowerment through preferential procurement)
  • the National Small Enterprise Amendment Act (intended to streamline government support services  for small and medium businesses, underpinned by a commitment to ‘broadening participation in the economy’ – especially by entrepreneurs from historically disadvantaged communities), and
  • the Climate Change Act (setting out a ‘national climate change response, including mitigation and adaptation actions’, as South Africa’s ‘fair contribution’ to the global response to climate change).

The final clauses of each Bill now signed into law tend to suggest that commencement of the Act concerned will be announced by special proclamation in the Government Gazette, with the Public Procurement Act being commenced incrementally.
