NEW NATIONAL ENVIRONMENTAL MANAGEMENT: BIODIVERSITY ACT REGULATIONS GAZETTED

Please note: On 31 March 2023, the Department of Forestry, Fisheries & the Environment gazetted a notice withdrawing all standards, lists and regulations published on 3 February 2023, as detailed in the article below. No explanation has been provided.

The Department of Forestry, Fisheries & the Environment has gazetted five notices under the National Environmental Management: Biodiversity Act. Three focus on iconic wild animals.

Of these, two introduce norms and standards for elephant management and leopard trophy hunting. One commences regulations affecting trade in and activities involving rhino horn.

  • Norms and standards on:
  • Notice announcing the 1 April 2023 commencement of regulations gazetted in June 2020:
    • allowing certain activities involving ‘adequately marked’ rhino horn (withdrawn), and
    • controlling trade in rhino horn (withdrawn).
  • In addition, notices have been gazetted:
    • updating the regulations on terrestrial and freshwater species (withdrawn), and
    • revising the list of terrestrial and freshwater species either threatened or protected (along with related restricted and/or prohibited activities, and restricted activity exemptions) (withdrawn).
