The Department of Social Development has called for input by 23 March 2023 on draft amendments to the Non-profit Organisation Act regulations. The intention is to align the regulations with provisions in the General Laws (Anti-Money Laundering & Combating Terrorism Financing) Amendment Act, 2022.
Unpacking what is envisaged, an explanatory memorandum notes, among other things, that:
- the proposed new Regulation 7A provides for the establishment and maintenance of a register of persons who have been disqualified, in terms of a court order, from serving as office bearers,
- the proposed new Regulation 9A introduces administrative sanctions for non-compliance with registration and reporting requirements, and that
- due cognisance has been taken of obligations under the Protection of Personal information Act, 2013.
The draft regulations were gazetted on 22 February 2023 but backdated to the previous day.
