The Department of Social Development has gazetted a notice in terms of which non-profit organisations have until 31 May 2024 to register, in keeping with requirements under the Non-profit Organisations Act, 1997.
The notice appears to apply specifically to non-profit organisations operating in South Africa but providing services and making donations to individuals and organisations outside its borders. According to the notice, these donations and/or services may be humanitarian, charitable, religious, educational or cultural.
Apparently related to this but not expressly mentioning the registration deadline, a media statement issued by the department on the same day as the Government Gazette notice’s publication refers to international Financial Action Task Force recommendations affecting ‘non-compliant non-profit organisations.
According to the statement, a moratorium placed on deregistering non-compliant organisations in 2012 has since been lifted. This may be linked to new regulations under the Non-profit Organisations Act in force since 8 May 2023, with the aim of enabling the monitoring of certain financial activities – in keeping with General Laws (Anti-Money Laundering & Combating Terrorism Financing) Amendment Act, 2022, requirements.
