NPA ACT: COMPLAINTS MECHANISM OPERATIONAL SOON

The Department of Justice & Constitutional Development has gazetted a notice declaring 1 March 2026 as the commencement date of section 8 of the 2024 National Prosecuting Authority (NPA) Amendment Act. Changes to the regulations concerned are included as a schedule to the notice.

Inserting section 22A in the principal statute, the 2024 amendment Act’s section 8 provides for the appointment of a retired judge to exercise oversight over NPA investigators. This is noting that the principal statute’s sub-sections 7(a) and (b) list the persons from whom complaints may be heard and evidence submitted regarding:

  • the serious and unlawful infringement of their rights resulting from the conduct of any other person in that list, or
  • any improper influence or interference, hindrance or obstruction (political or otherwise) experienced while carrying out their duties.

This is expected to improve the NPA’s accountability.

All other sections of the 2024 amendment Act came into force in August 2024.
