NPA AMENDMENT BILL: DRAFT SUBMITTED TO PARLIAMENT

A draft National Prosecuting Authority Amendment Bill has been submitted to Parliament for information and planning purposes only. It has yet to be certified by the Office of the Chief State Law Adviser and formally introduced. As a result, at this stage the uncertified draft is the only document available.

According to a Department of Justice & Constitutional Development media statement, once enacted and operationalised the proposed new piece of legislation is expected to ensure ‘the effective implementation’ of Zondo Commission report recommendations. To that end, the Bill seeks to make the Investigating Directorate Against Corruption ‘a permanent feature of … (government’s) anti-corruption law enforcement efforts’. This is apparently in keeping with international best practice for ensuring that crimes involving corruption are prosecuted.
