OATHS AND AFFIRMATIONS: DRAFT REGULATIONS OUT FOR COMMENT

The Department of Justice & Constitutional Development has called for input by 31 August 2026 on draft regulations under the 1963 Justices of the Peace & Commissioners of Oaths Act. Once finalised, they will repeal and replace those in force since 1972.

Significantly more comprehensive than the prevailing regulations, among other things their proposed replacement covers:

  • the duties of a commissioner
  • prohibited actions
  • signing a declaration
  • electronic commissioning, and
  • certification procedures.
