OCCUPATIONAL HEALTH & SAFETY: GENERAL MACHINERY REGULATIONS TO BE REPLACED

The Department of Employment & Labour has gazetted draft regulations on general machinery under the 1993 Occupational Health & Safety Act with the intention of repealing and replacing those in force since August 1988. The deadline for public comments is 20 November 2025.

As in the case of the 1988 version, among other things the proposed replacement regulations cover:

  • supervision, focusing on:
    • machinery used to generate electricity (revised to include new technology), and
    • an employer’s obligation to designate associated responsibilities to a full-time suitably competent staff member
  • safeguarding machinery (including all non-power generating machines)
  • operating machinery
  • ‘working on moving or electrically alive machinery’
  • devices to start and stop machinery, and
  • incident reporting.
