OCCUPATIONAL INJURIES AND DISEASES: INPUT SOUGHT ON DRAFT REGULATIONS

The Department of Employment & Labour has called for input by 16 June 2024 on three sets of draft regulations under the Compensation for Occupational Injuries & Diseases Act, 1993.

The proposed definition of ‘the period of prescription of claims’ seeks, among other things, to provide:

  • for the retrospective consideration of claims in respect of domestic employees ‘from 27 April 1994’:
    • whether reported or not, but
    • submitted within three years from the new regulations’ date of commencement.

The draft regulations on compliance and enforcement inspections focus on:

  • the procedures to be followed before conducting an inspection and during the ensuing process, and
  • the rights and obligations of the employer concerned.

The draft regulations on the mandatory registration of third parties transacting with the Compensation Fund, focus on:

  • medical service providers
  • employer representatives
  • the terms and conditions for transacting with the Fund, and
  • related administrative requirements, processes and procedures.
