OFFSHORE EXPLORATION & PRODUCTION RIGHTS: ENVIRONMENTAL REHABILITATION

The Department of Forestry, Fisheries & the Environment has called for input by 9 January 2024 on the proposed extension of transitional arrangements in the 2015 financial provisioning regulations. This is noting that, in September 2023, a notice was issued extending to 19 February 2024 the compliance deadline for holders of rights and permits for which applications were made before 20 November 2015 under the Mineral & Petroleum Resources Development Act, 2002.

The latest notice expressly refers to the holders of offshore exploration and production rights. Somewhat confusingly, however, no new date is provided. Clarity is therefore required on:

  • whether the notice is calling for public comments on including offshore exploration and production rights holders in a transitional arrangement scheduled to end on 19 February 2024
  • if that deadline is to be extended and, if so, for how long, and
  • if any proposed the new deadline will also apply to the holders of onshore rights and permits meeting the prescribed criteria.
