ONLINE INTERMEDIATION PLATFORM GUIDELINES PUBLISHED

The Competition Commission has gazetted a notice announcing the publication of guidelines to large online intermediation platforms with market power operating in South Africa.

Informed by the outcome of an inquiry concluded in 2023, the guidelines focus on specific types of conduct that could ‘raise competition concerns’ – as well as practices that might be considered harmful to local platforms or businesses.

In that context, a preface to the document advises any large platform operating in South Africa and incorporating certain practices in their business model to consider:

  • ‘whether they are necessary,’ and, if so,
  • ‘whether there are strong efficiency justifications for such practices as part of their internal compliance’.
