PARLIAMENT: EXTRADITION BILL FINALLY TABLED

Parliamentary papers have confirmed that the long-awaited Extradition Bill has finally been tabled – more than a year after receiving Cabinet approval.

Once passed by Parliament, enacted and operationalised the proposed new piece of legislation will:

  • ‘make provision for modern extradition trends’
  • ensure that international law obligations are met
  • introduce ‘procedures and mechanisms to simplify and expedite extradition requests’
  • provide for the ‘necessary practical arrangements’, and
  • clarify the roles and responsibilities of certain functionaries involved in extradition proceedings.

Underpinned by constitutional imperatives and in line with various Constitutional Court judgments, it will eventually repeal and replace the 1962 Extradition Act. More information is available in earlier SA Legal Academy reports, links to which are provided below.
