More than three years after its formal introduction in Parliament, the Older Persons Amendment Bill has been passed and sent to President Cyril Ramaphosa for signature. This is according to recently published parliamentary papers and follows a decision by the National Assembly’s Social Development Committee to endorse changes to the Bill proposed by its NCOP counterpart.
Once operationalised, among other things the new piece of legislation will enable the authorities concerned to move an older person to temporary safe care without a court order. However, the Parliamentary Monitoring Group (PMG) report of a 16 May 2025 National Assembly Social Development Committee meeting on the Bill draws attention to reservations expressed in a South African Police Service submission regarding the practicalities of implementing these provisions. At the time, members were nevertheless assured by a Department of Social Development official that these issues will be addressed in the regulations.
Once in force, the enacted Bill is also expected to deal with ‘challenges’ experienced in the context of inter-sectoral co-ordination and institutional compliance. This is according to a memorandum on the Bill’s objects, which refers expressly to ‘community-based and residential care facilities’.
