PENSION FUNDS ACT: INPUT SOUGHT ON UNCLAIMED BENEFITS DRAFT INTERPRETATION RULING

The Financial Sector Conduct Authority has called for input by 26 September 2023 on a draft replacement interpretation ruling affecting the treatment of unclaimed benefits under sub-section 37C of the Pension Funds Act, 1956, as amended.

According to the accompanying communication, ‘certain unintended consequences’ have arisen in the application of sub-section 37C in terms of an interpretation ruling in force since March 2020.

The draft replacement ruling seeks to clarify what is required regarding the payment of unclaimed benefits following the death of a member.
