PERFORMERS' PROTECTION AMENDMENT BILL: NCOP COMMITTEE CALLS FOR INPUT

The NCOP Committee on Trade & Industry, Economic Development, Small Business, Tourism and Employment & Labour has issued a notice calling for written submission by 27 January 2023 on the revised Bill ('D' version) in its entirety.

The same notice also calls for input on the revised Copyright Amendment Bill, which impacts on certain provisions in the Performers' Protection Amendment Bill. Once again, input is sought on the entire Bill.

Both Bills were passed in 2019 and sent back to Parliament more than a year later, based on the President’s concerns about the constitutionality of some clauses – as well as procedural irregularities with implications for the constitutionality of the parliamentary process itself.

The Bills have since been revised to address the President’s concerns, with a ‘D’ version of each Bill having been passed by the National Assembly on 1 September 2022 and sent to the NCOP for concurrence.

The revised Bills will be the focus of a comprehensive public participation process expected to begin in February 2023 and later moving to the provincial legislatures.
