PETROLEUM PRODUCTS: INPUT SOUGHT ON DRAFT BILL TO REPLACE 1977 ACT

The Department of Mineral Resources & Energy has gazetted a draft Petroleum Products Bill for input by 20 December 2024. This follows Cabinet’s approval of the proposed new piece of legislation for public consultation. Although no memorandum on the Bill’s objects is provided, according to a media statement on the Cabinet meeting at which it was approved the draft Bill seeks to ensure:

  • a secure supply of petroleum products, and
  • the sector’s ‘orderly development’, including the introduction of ‘modern, cleaner products and renewable components’.

This is expected to:

  • ‘improve the energy mix’, and
  • ‘address … concerns … raised in relation to the administration of the Petroleum Products Act, 1977, which will eventually be repealed.

In that regard, the Cabinet statement also referred to the Bill’s role in:

  • contributing towards economic transformation and job creation
  • facilitating ‘broader representation’
  • improving efficiency and cost effectiveness
  • facilitating more competitive petroleum product manufacturing, wholesaling and retailing
  • promoting ‘good industry practices’, and
  • improving compliance.
