PLANT HEALTH (PHYTOSANITARY) ACT: DRAFT REGULATIONS OUT FOR COMMENT

The Department of Agriculture, Land Reform & Rural Development has gazetted three sets of draft regulations under the yet-to-be-commenced 2024 Plant Health (Phytosanitary) Act, calling for comments by 26 October 2025.

Among other things, the draft control regulations seek to:

  • prohibit:
    • the possession of regulated pests
    • the movement of infested plants, plant products and other articles
    • keeping, planting or cultivating regulated plants, plant products and other articles (including for research purposes)
  • provide for:
    • the destruction of any such plants and plant-related material
    • notification obligations in the context of regulated pest occurrences on land in pest-free areas
    • serving orders requiring the introduction of appropriate control measures, and
    • procedures to be followed when demarcating quarantine areas.

The draft import regulations cover, among other things:

  • permit application and processing procedures
  • consignment inspection
  • consignment detention, quarantine and post-quarantine measures
  • biological control agent import permit requirements, and
  • research-related plant import permit requirements.

The draft export regulations focus on:

  • permit application and processing procedures
  • phytosanitary certification requirements, and
  • in-transit permit application and processing procedures.
