The National Assembly’s Home Affairs Committee intends holding public hearings on the House resolution required to give effect to a recent Western Cape High Court ruling on a lacunae in the Electoral Matters Amendment Act, 2024 regarding political party donation and disclosure limitations. With that in mind, the committee is expected to issue a notice soon calling for written submissions on the wording proposed.
At the time of writing, neither the draft resolution itself nor a timeframe for the public participation process was available. However, according to the committee media statement announcing these plans, the draft resolution will seek to ensure that:
These amounts featured in sections 7 (upper limit of donation) and 9 (disclosure limit) of the Political Party Funding Act, 2018 but were removed by the Electoral Matters Amendment Act when it came into force on 8 May 2024.
Readers are advised that the committee media statement erroneously refers to the Electoral Matters Amendment Act, 2014 (2024 is the correct year) and ‘items 7 and 9 of Schedule 2’ of an unspecified Act (sections 7 and 9 of the Political Party Funding Act is the correct reference).
