POPIA: INPUT SOUGHT ON HEALTH/‘SEX LIFE’ DATA ACCESS REGULATORY PROPOSALS

The Information Regulator has called for input by 10 October 2025 on draft regulations under the 2013 Protection of Personal Information Act intended to:

  • provide for ‘better transparency to data subjects on the manner in which their health and sex life information may be used’, and
  • enable the Regulator and data subjects to challenge the use of any such information exceeding the boundaries proposed.

Once finalised, the regulations will apply to insurance companies, pension funds medical schemes and managed healthcare organisations – as well as all associated administrative bodies, institutions and personnel.

Among other things, the proposed new regulations cover:

  • information processing
  • legitimate interest assessment
  • authorising access to information in the public interest
  • appropriate technical and organisational safeguard measures, and
  • information transfer to other countries.
