POPIA: INPUT SOUGHT ON RESIDENTIAL COMMUNITIES COUNCIL DRAFT CODE OF CONDUCT

Please note: On 11 September 2023, the draft code of conduct was made available in response to an email request. By that time, 11 of the 14 days allowed for public comment remained.  

The Information Regulator has gazetted a notice calling for public comments by 22 September 2023 on a draft code of conduct submitted by the Residential Communities Council in terms of requirements in the Protection of Personal Information Act, 2013.

At the time of writing, the document had not yet been published on the Information Regulator’s website – thus potentially reducing the public commentary period.

Nevertheless, according to the notice, once finalised the code is expected to:

  • promote compliant personal information processing  practices by Council members
  • facilitate ‘appropriate agreements’ between Council members and third parties on personal information processing, as required by the Act and ‘dictated by good business practice’, and
  • establish procedures for considering complaints and taking remedial action when necessary.
