PRIVATE SECURITY INDUSTRY: INPUT SOUGHT ON COMPLAINTS-HANDLING REGULATIONS

The Private Security Regulatory Authority has called for input by 21 July 2023 on draft regulations among other things requiring the establishment of a dedicated complaints management office. Expected to ‘enhance the efficiency and effectiveness of investigations’, among other things the proposed new regulations outline:

  • the procedures to be followed when lodging and processing a complaint
  • the timeframe within which the necessary action should be taken
  • the process of assessing a complaint and referring it to a competent authority
  • dealing with investigations requiring expert assistance, and
  • conciliation and settlement procedures.

The draft regulations appear to be the next step in enforcing a code of conduct for service providers gazetted in February 2003, with regulations on ‘improper conduct enquiries’. The code of conduct was amended in July 2016.
