PUBLIC ADMINISTRATION MANAGEMENT AMENDMENT BILL LEAVES PARLIAMENT

Parliament has passed a ‘B’ version of the Public Administration Management Amendment Bill, which has been sent to President Cyril Ramaphosa for signature. This is according to recently circulated parliamentary papers.

Tabled in May 2023, once enacted and operationalised the new piece of legislation is expected to improve service delivery by aligning human resource, governance and related arrangements across all three spheres of government. This is according to a memorandum on the Bill’s objects. Other issues addressed in the Bill include:

  • matters related to employee transfer and secondment
  • measures prohibiting employees from ‘conducting business with an organ of state’
  • matters related to the National School of Government
  • ‘unjustifiable disparities across state institutions’, and
  • public administration collective bargaining mandating processes.

Apparently, in the absence of repeal or other mechanisms to address policy and functional ‘overlaps’ between the 2014 Public Administration Management Act and ‘other legislation’, the principal statute’s full implementation is ‘impossible’. In that regard, the memorandum refers to:

  • ‘fiscal and other considerations’, and
  • the ‘onerous’ procedural requirements associated with developing implementing regulations.
