PUBLIC ADMINISTRATION BILLS READY FOR NCOP

The National Assembly’s Public Service & Administration Committee has completed its work on two Bills, revised versions of which are ready for second readings in the House – with the relevant reports. Once passed, these Bills will be sent to the NCOP for concurrence. Both were tabled in May 2023 and are section 76 pieces of legislation with implications for the provinces.

The Public Administration Management Amendment Bill seeks to address some of the challenges experienced in implementing the principal statute, the purpose of which was to streamline public administration organisation, management, functioning and personnel-related matters across all three spheres of government. Many sections of the Act have yet to be commenced. Against that backdrop, the Bill provides for a ‘co-ordinated mandating processes’ for determining public sector remuneration and conditions of service and is therefore expected to eliminate ‘unfair disparities’ in that regard.

The Public Service Amendment Bill:

  • seeks to align the principal statute with policy reforms in the National Development Plan, 2030, and
  • respond to:
    • ‘various court decisions relating to the field of public administration’, and
  • ‘matters identified by the South African Law Reform Commission’s report on legislation administered by the Department of Public Service & Administration.
