PUBLIC ADMINISTRATION MANAGEMENT AND PUBLIC SERVICE AMENDMENT BILLS OPEN FOR SUBMISSIONS

In anticipation of parliamentary hearings on the Public Administration Management Amendment Bill, the National Assembly’s Public Service & Administration Committee has called for written submissions. According to the notice announcing this, the deadline for input has been set at 28 July 2023.

Tabled in May, the Bill seeks to address challenges experienced in implementing the principal Act, which joined the statute books in 2014. It took nearly five more years to operationalise seven of the Act’s 20 sections. Three not yet in force seek to:

  • establish an ‘Ethics, Integrity and Disciplinary Technical Assistance Unit’ and an ‘Office of Standards Compliance’, and
  • empower the Minister to prescribe minimum norms and standards on, among other things:
    • capacity development and training, and
    • ‘measures to improve the effectiveness and efficiency of (state) institutions’.

In that context, a memorandum on the Bill’s objects refers to ‘fiscal and other considerations’ apparently stemming from the need for regulations. These ‘can only be approved under onerous circumstances requiring the concurrence of (various) Ministers … and the South African Local Government Association’.

In a separate notice, the same committee has called for submissions by 28 July 2023 on the Public Service Amendment Bill, which seeks to align the Public Service Act, 1994, with:

  • policy reforms in the National Development Plan
  • South African Law Reform Commission recommendations, and
  • ‘various court decisions’.
