The National Assembly’s Standing Committee on Finance has adopted a ‘B’ version of the Public Procurement Bill incorporating amendments in an ‘A’ list ‘presented to the committee on 1 December 2023’. This is according to a report tabled in the House three days later. The Bill’s second reading feature’s on a list of matters prioritised for the National Assembly’s final sitting for the year, which will take place on 6 December 2023.
At the time of writing, the Bill’s revised version was not available. However, a memorandum on its objects notes that its purpose is to create ‘a single framework (for) regulating procurement’ – underpinned by a policy providing for ‘categories of preference in the allocation of contracts and the protection or advancement of persons disadvantaged by unfair discrimination’.
Among other things, the committee report confirms that, following parliamentary hearings during September 2023, ‘National Treasury undertook a comprehensive revision’ of the Bill’s contents. This resulted in ‘substantial changes’ – most notably ‘the complete redrafting of Chapter 4, specifically addressing preferential procurement’.
Once passed by both Houses, enacted and operationalised, the Bill will repeal the Preferential Procurement Policy Framework Act, 2000, and make material amendments to several other pieces of legislation.
