PUBLIC SERVICE COMMISSION BILL MOVES TO THE NCOP

The National Assembly has passed a ‘B’ version of the Public Service Commission Bill, which has been sent to the NCOP for concurrence. This was announced in a parliamentary media statement among other things noting the Bill’s potentially ‘significant role’ in creating ‘an efficient, innovative, and responsive public service.

According to a memorandum on the Bill’s objects, its overarching purpose is to enhance the Commission’s independence by:

  • providing for:
    • ‘a clear public administration mandate’, and
    • a dedicated secretariat, and
  • positioning the Commission as a ‘constitutional institution reporting to Parliament’ (thus enabling the legislative arm of government to oversee its executive arm more effectively).

This is expected to improve the Commission’s capacity for ‘responding to the problems of corruption’ and promoting integrity not only in the public service itself but across the entire system of public administration.

Tabled in October 2023, once passed by Parliament and operationalised the proposed new statute will repeal the 1997 Public Service Commission Act.
